Terms of Use

These terms are an agreement between you and Tepoyan Studio ("the developer") covering the Pahust application for iPhone, iPad, Mac and Apple Watch ("the app"). By downloading or using the app you accept them. If you do not accept them, do not use the app.
Pahust is a planning tool, not financial advice. It performs arithmetic on numbers you enter and shows you the consequences of your own decisions. It is not a bank, a broker, an accountant or an adviser, and nothing it displays is a recommendation to do anything with your money.
1. Licence
You are granted a personal, non-transferable, non-exclusive licence to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The licence covers use of the app; it does not transfer ownership of it. You may not sell, rent, sub-licence, redistribute or reverse-engineer the app except to the extent the applicable law expressly permits.
2. Purchases and subscriptions
The app is free to download and use. The free tier includes the complete forecasting and solvency engine and is limited to 2 income streams, 4 accounts and 3 debts. Removing those limits is optional and is offered in two forms, which unlock exactly the same thing:

Prices are shown in US dollars. Your local price is set by Apple's regional pricing and is always displayed, in your own currency and including applicable taxes, before you confirm a purchase.
Auto-renewal, in full
- Payment is charged to your Apple Account at confirmation of purchase.
- The annual subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the subscription in effect at that time.
- You can manage your subscription and turn off auto-renewal at any time in Settings → your name → Subscriptions on iOS, or App Store → Account → Settings on Mac. Cancelling stops future renewals; it does not refund the current period.
- If a free trial is ever offered, any unused portion of it is forfeited when you purchase a subscription to the same product.
- The one-time Lifetime purchase is not a subscription. It does not renew and cannot be cancelled, because there is nothing recurring to cancel.
Purchases are tied to your Apple Account and can be restored on your other devices with Restore Purchases in the app's settings. If a price changes, the change applies only to future purchases and future renewals, and Apple will notify existing subscribers as its rules require.
Refunds
All purchases are processed by Apple, and refunds are handled by Apple under its own terms — the developer cannot issue one. Request a refund at reportaproblem.apple.com. If something in the app is broken, please write first; a bug is usually faster to fix than a refund is to process.
3. Your data is yours, and so is keeping it
The app stores your plan on your device and, if you are signed into iCloud, in your own private iCloud database. The developer has no copy of it and therefore cannot restore it for you. Export or back up anything you would be sorry to lose — the app can produce a complete JSON backup, an encrypted local backup and a spreadsheet, all from Settings. What the app does with your data, and the two public endpoints it contacts, are described in the Privacy Policy, which forms part of these terms.
4. No warranty
The app is provided "as is" and "as available", without warranty of any kind to the fullest extent the applicable law permits. The developer does not warrant that the app will be uninterrupted or error-free, that its projections will match what actually happens, or that market and currency data obtained from third-party public endpoints will be accurate, current or available. Planning rates are yours to set — the app deliberately encourages you to set them worse than the market — and any figure derived from them is an assumption, not a fact about the future.
Nothing in these terms limits any right you have under the consumer-protection law of your own country that cannot be limited by agreement.
5. Limitation of liability
To the fullest extent permitted by law, the developer is not liable for any financial loss, missed payment, lost data or other indirect or consequential damage arising from your use of the app, including from acting on a projection it produced. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.
6. Maintenance and support
The developer is solely responsible for any maintenance and support for the app. Apple has no obligation whatsoever to furnish maintenance or support services. Support is available at pahust.tepoyan.com/support.
7. Apple's role
Required by Apple, and true:
- This agreement is between you and the developer only, not with Apple. The developer, not Apple, is solely responsible for the app and its content.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- The developer, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
- The developer, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance of it, have the right to enforce it against you.
8. Legal compliance
You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
9. Third-party terms
You must comply with any applicable third-party terms when using the app — for example the terms of your wireless data plan, and Apple's terms for iCloud and for purchases made through the App Store.
10. Changes to these terms
These terms may be updated as the app changes. The date at the top changes with them, and a material change is noted in the app's release notes. Continuing to use the app after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the jurisdiction in which Tepoyan Studio is established, without regard to its conflict-of-law rules, and without depriving you of the protection of the mandatory consumer law of your country of residence.
